Daniella Guzman on issues concerning death convictions

Daniella Guzman is the last defendant to be sentenced in connection with the fatal stabbing of 17-year-old Justice Afoa in 2010, a killing that led the victim’s friend on Newark Memorial High School football team’s murder in two years later. Judge Morris Jacobson sentenced Daniela Guzman on Friday to 15 years to life in state prison after she told a courtroom full of Afoa’s family members that she was remorseful for her role in Afoa’s death, her attorney Ernie Castillo said.

In June she was convicted in a second-degree murder and conspiracy to commit assault at a trial in which prosecutor Elgin Lowe argued that it was Guzman’s direction, lies, and manipulations that led to her brother Rafael Tovar and his fellow gang member Daniel Howard killing Afoa on Dec. 15, 2010.

All three were arrested just days before the two-year anniversary of Afoa’s death. After waiting five years and watching three separate trials, Afoa’s mother on Friday thanked Lowe and all the jurors, judges, and police officers involved in the case, Lowe said.

“She continues to grieve every day for her son,” Lowe said. “At least this part is over. Now she is planning a celebration of her son’s life.” Tovar and Howard were each convicted of first-degree murder at separate trials. Tovar is serving a sentence of 29 years to life at San Quentin State Prison.

Howard, 33, is at Calipatria State Prison. He was sentenced to 70 years to life for killing Afoa and for trying to kill his pregnant girlfriend in a separate incident in Fremont in 2012.

She argued that Tovar plotted Afoa’s murder in revenge for Afoa beating up Tovar to the point of hospitalization in September 2010 at a party where Tovar had picked a fight with a boy who was Afoa’s friend and Guzman’s ex-boyfriend. Lowe told jurors Guzman first set up Afoa to be attacked at a 2010 Halloween party, where Afoa and another boy were stabbed with a broken beer bottle. Tovar and Guzman’s cousin Anthony Bernal, 25, were sentenced to 12 years for stabbing that second teen.

On the day Afoa was killed, Guzman tracked his movements and directed his killers to his whereabouts, Lowe argued. Castillo argued that it was Tovar’s “death before dishonor” gang mentality that led to Afoa’s death and that, although Guzman made immature and negligent decisions, she did not want her classmate dead.

Afoa’s death set off a chain of events that led to his friend and fellow Newark Memorial football player star Osana Futi, 18, being killed by a Fremont gang member in April 2012 during a confrontation over Afoa’s then-unsolved murder.

Abraham Hade, 21, was convicted of second-degree murder for Futi’s death and is serving a sentence of 16 years to life. Lowe prosecuted everyone involved in Futi’s and Afoa’s murders. “For me, it’s sad and tragic reality kids are gone and the defendants ruined their lives because of all this foolishness,” Lowe said. “As much as they wanted that revenge, I bet if you ask them right now, they’d say it was not worth it.”
